Slip and Fall Case

Slip and fall cases are a broad category of personal injury cases where the plaintiff takes a serious fall, on the property of another, and is injured.  Some slip and fall injuries can be very serious, even life changing.  These falls can occur on stairs, store aisles, parking lots, ramps, sidewalks, hall ways, as well as other locations.

However, this type of case must be carefully looked at to determine if it will pass legal muster in Idaho.  The injured person must be able to point to some action the property owner failed to do that resulted in their injury.  For example, failed to market dangerous stair trend that needed repair or failed to clean up an oil spill they were aware of and had time to do so.  The fact that someone fell is not enough, by itself, to make a case.

Additionally, the injured person must be able to show what it was that caused their fall.  People are expected to keep a proper look out as they move about; however, careful fact analysis is needed to determine liability.  The more information collected when the injury occurs, the better.
